CLIENT WAIVER & MODEL RELEASE
I understand that my session fee covers my initial consultation, session date, agreed upon time, location, lightly edited proofs, online proofing gallery of all digital images with print release, and any additional sessions included in my collection. I further understand that my session does not include printed photographs, or images on USB. I acknowledge that I can expect presentation of the session images via password protected MBP client viewing site. I further acknowledge that Michelle will set up an in person ordering session at the clients request or the client may choose to order directly through their viewing gallery . All images must be downloaded while the gallery is active , there will be a $50 reactivation fee thereafter.
I understand that it is my responsibility to schedule my senior session. I understand that I am not allowed to add filters to my images, and screenshot images. I understand MBP must be tagged in all images shared to social media.
I understand that MBP retains the copyright and ownership of all images created during the portrait session and has the right to make reproduction of images for portfolio samples, print and/or web display, self-promotion, competition, and peer review. I further acknowledge that I will not receive any compensation for the use of said images used by MBP. I further acknowledge that it is illegal to copy, scan or otherwise reproduce copyrighted images without express written permission by MBP.
I hereby release MBP, it’s contractors, it’s employees, and any third parties involved in the creation or publication of marketing materials, from liability for any claims by me or third party in connection with my participation.
LIABILITY WAIVER
By agreeing to a photography session with Michelle Barclay Photography, I am hereby waiving, releasing, and discharging Michelle Barclay and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. MBP is not responsible for any injuries inflicted upon any participating parties. MBP is not and can not be held responsible for any injury or accident sustained or related to your photoshoot such as, but not limited to, snake bites, broken bones due to falls, and car accidents. Client agrees it is at their own risk to be photographed at agreed upon locations, and is aware there may be certain risks involved. Client(s) will be responsible for their children and for themselves and release the photographer from any claims against their person or their business. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Michelle Barclay and Michelle Barclay Photography for any reason. By completing and signing this contract you acknowledge that you agree to and understand the terms and conditions herein. You are waiving certain legal rights, including the right to sue Michelle Barclay and Michelle Barclay Photography, it’s organizers, and members.
COVID
Release of liability should the client or any present party contract COVID-19 WITHIN 14 DAYS OF THE SESSION: If client or anyone they live with exhibits symptoms of COVID-19 the session maybe reschedule at no charge. I, in turn, release liability from clients if I get sick.
